我為什麼要加入工會?

Why should I join the union?

We decided to form a union here at Mohegan Sun because our conditions have deteriorated over the years. Without a union, management makes all of the decisions, all of the time. With a union, management must sit down and bargain with us. With a union, we will have the resources to bring experienced negotiators to the table with us. With a union, we are part of a much bigger organization of workers with similar concerns and similar desires. By joining together with a union, our resources are multiplied and we can negotiate with management as equals.

Why the UAW?

Mohegan Sun dealers approached the UAW about forming a union because of the UAW’s strong track record at Foxwoods. The UAW represents the largest number of dealers in the country. About 10,000 gaming industry workers are members of the UAW across six states, including Connecticut, Florida, Indiana, Michigan, New Jersey and Rhode Island.

I heard that Foxwoods dealers don’t feel the union is doing anything for them.

The overwhelming majority of dealers at Foxwoods would tell you if it weren’t for the union, the new management would have made drastic changes in benefits and in the general working conditions. Because of the union, management has to abide by the contract, and when it expired, management still couldn’t make changes, they have to bargain with the committee of union dealers.

Since the union, hundreds of dealers have used the union to deal with management when they have a problem. The union has won reinstatement of dozens of workers who were fired unfairly and has solved major problems.

When Foxwoods dealers negotiated their first contract, the casino was in big trouble with its financial backers. The tough economy hit hard, and management looked for ways to save money everywhere, laying off hundreds of workers throughout the administration and hotel, including 23 dealers.

Because of the union, the only concession made was a one-year suspension of the 401k match and all of the laid off poker dealers were brought back. In addition, the union negotiated for quaranteed wage increases, dual rate and full-time promotions, the ability to audit dealer hours, a smoke-free pit, the creation of a regular and real testing for second hand-smoke, benefits for part-timers, job security, a fair procedure to resolve grievances and much more.

Could I lose my job if I support the union/sign a union card?

It is unlawful under both tribal and federal law for Mohegan management to discriminate against any of us for exercising our rights. We have a right under the law to join with our coworkers to form a union and to have a say about our working conditions through negotiating a union contract. The more public we are in our support for the union the more protected we are under the law.

During the Foxwoods organizing, a dealer named Dave Ellsworth, who was very public in his support for the union, was unfairly terminated. The union filed a charge at the labor board and got him back to work with backpay!

Will my boss find out if I sign a card?

While it is the policy of the UAW not to hand cards over to management, we don’t have to keep the fact that we signed a card a secret. We have the right to form a union under both federal and tribal labor law. When the union organized at Foxwoods, many dealers signed up during break time, right in front of their supervisors! Of course, if one of our co-workers prefers to keep their card confidential, we will respect that.

It is unlawful under tribal and federal law for Mohegan management to discriminate against any of us for exercising our rights. We have a right under the law to join with our coworkers to form a union and to have a say about our working conditions through negotiating a union contract. The more public we are in our support for the union the more protected we are under the law.

What are the union dues?

Dues are not collected until a majority of us vote to accept our contract. Dues are 1.15% of base rate plus toke rate, but no one will pay more than $35 per month. With negotiated raises, the cap on our dues could go up to reflect our wage increase. At Foxwoods, the cap went up $1 per month, at the same time wages went up.

UAW members contribute dues in order to have the resources and experts to win good union contracts, to make sure management abides by the contract, and to help others form their own union.

Will we have to go on strike?

In order for a strike to happen, 2/3 of the membership in a workplace needs to vote yes to authorize a strike. 98% of all union contracts are settled without a strike. However, Foxwoods dealers decided to negotiate under tribal law; binding arbitration is used to resolve differences in negotiations, instead of a strike.

I heard that poker dealers will have to pool tips with table games dealers if the union comes in. Is that true?

Not true, having a union means dealers decide on what they do with their tokes and tips. At Foxwoods before the union, tokes were pooled among all table games and poker dealers. In the first contract, poker dealers won the right to a vote to separate from the toke pool. Last year, through a process established by their Toke Committee, Foxwoods dealers voted to separate poker tokes from table games tokes and Poker dealers voted to keep their own individual tips.

I heard there were layoffs at Foxwoods. What did the union do about that?

Since the Foxwoods dealers negotiated their first contract in January 2010, there has never been a single layoff of dealers. However, when Foxwoods illegally laid off 23 poker dealers before the contract was finished, the union challenged the layoffs and won reinstatement of all these poker dealers with their seniority preserved.

The recent layoffs you may be hearing about occurred in the engineering department.
